Rape Of A Child Under 16

The crime of rape of a child is defined as the sexual intercourse or unnatural sexual intercourse with a child under 16, where the child is compelled by force against his/her will to engage in such acts.

Massachusetts General Laws Chapter 265, Section 22A punishes the rape of a child under 16 with imprisonment in State Prison for life or for any term of years.

As in all criminal offenses involving rape, a conviction for rape of a child under 16 would render the offender subject to the requirements of sex offender registration; the person would be required to submit his/her DNA to the state’s DNA database; subject the offender to a term of community parole supervision for life; and could also serve as a predicate ‘sexual offense’ for civil commitment as a “sexually dangerous person.”
