Unlawful Possession Of A Large Capacity Firearm Or Feeding Device
Massachusetts gun laws prohibit the unlawful possession of a large capacity firearm or feeding device, and General Laws Chapter 269, Section 10(m) proscribes a term of imprisonment of not less than 2.5 years and up to 10 years in state prison.
A person convicted of the crime of unlawful possession of a large capacity firearm or feeding device and who had a valid Firearms Identification Card at time, would be subject to a lesser minimum-mandatory sentence of not less than one year and up to 10 years in state prison.
Massachusetts gun crime laws define a “large capacity weapon” as any firearm, rifle or shotgun that meets one of the following criteria:
- Is a semi-automatic with a fixed large capacity feeding device
- Is a semi-automatic and capable of accepting, or readily modifiable to accept, any detachable large capacity feeding device
- Employs a rotating cylinder capable of accepting more than 10 rounds of ammunition in a rifle or firearm, and more than 5 shotgun shells in the case of a shotgun or firearm
- Is an assault weapon
A “large capacity feeding device” is defined under Massaschusetts law as:
- A fixed or detachable magazine, drum, feed strip or similar device capable of accepting more than 10 rounds of ammunition or more than 5 shotgun shells
- A large capacity ammunition feeding device as defined in the Federal Public Safety and Recreational Firearms Use Protections Act.
