Assault With Intent To Commit Rape

The crime of assault with the intent to commit rape is committed when one assaults another person with the intent to engage in sexual intercourse or unnatural sexual acts without their consent.

Massachusetts General Laws Chapter 265, Section 24 punishes offenders of the crime of assault with the intent to commit rape with imprisonment for life or for any term of years. However, if the criminal offender committed assault with intent to rape with the use of a firearm, then Massachusetts law imposes a minimum-mandatory sentence of not less than five years to be imposed. Additionally, if the person was previously convicted of assault with the intent to commit rape, then the minimum-mandatory sentence to be imposed would be 20 years.

As with all rape crimes, a conviction for assault with the intent to commit rape would render the offender subject to sex offender registration; submittal of his/her DNA to the state’s DNA database; could be subject to a term of community parole supervision for life; and may also serve as a predicate sexual offense for civil commitment as a “sexually dangerous person.”
