Indecent Exposure

In Massachusetts, the crime of indecent exposure is punishable with imprisonment for up to six months in the House of Corrections and/or a fine of up to $200.

In order to be convicted of indecent exposure, the prosecutor is required to prove, beyond a reasonable doubt:

• That the defendant exposed his/her genitals to one or more persons
• That the defendant did so intentionally
• That one or more persons were offended by the defendant exposing himself

The crime of indecent exposure is a misdemeanor criminal offense and only applies to the exposure of genitalia, and not to exposure of the genital area, pubic hair, buttocks or female breasts. Additionally, it makes no difference whether the crime of indecent exposure is done in public.

By contrast, the crime of open and gross lewdness and lascivious behavior includes the intentional exposure of genitalia, buttocks or female breasts but has the additional element that it must be done in a way as to produce alarm or shock.
