Assault By Means of A Dangerous Weapon

Massachusetts General Laws Chapter 265, Section 15B, governs the crime of Assault By Means of a Dangerous Weapon, which is punishable by imprisonment in the House of Corrections for up to 2.5 years, or to state prison for up to 5 years.

In order to prove the crime of Assault By Means of a Dangerous Weapon, the prosecutor must prove, beyond a reasonable doubt, that:
  1. The defendant committed an assault;
  2. The defendant intended to commit an assault; and
  3. The assault was done with a dangerous weapon.
It must be proven that the defendant intended the assault with a dangerous weapon, meaning that he consciously and deliberately intended the assault to occur.  In other words, the assault was not merely accidental or negligent.
