Possession of Child Pornography

Massachusetts law defines the Sex Crime of Possession of Child Pornography as the possession of a photograph or visual reproduction, or depiction by computer, of any child whom the person knows or reasonably should know to be under the age of 18, and the child is:
  • engaged in any act of sexual intercourse;
  • engaged in any of masturbation;
  • portrayed as being the object of or engaged in any act of lewd fondling, touching, or caressing of another person;
  • engaged in any act of excretion or urination within a sexual context;
  • depicted as bound, fettered, or subject to sadistic, masochistic, or sadomasochistic abuse in any sexual context; or
  • depicted in any pose, posture or setting involving the lewd exhibition of the unclothed genitals, pubic area, buttocks, etc.
The penalty for the crime of Possession of Child Pornography in Massachusetts is up to 5 years in state prison for a first offense; not less than 5 years in state prison for a second offense; and not less than 10 years in state prison for third and subsequent offenses.

Additionally, a conviction for this Sex Crime renders the person subject to the requirements of the Massachusetts Sex Offender Registry Law.
