Commonwealth v. S.B., Roxbury Division of the Boston Municipal Court

A concerned motorist calls the Massachusetts State Police to report a 'drunk driver' on Storrow Drive.  The Defendant is later stopped in Kenmore Square for failing to stay in his lane and for suspicion of Drunk Driving.

According to the Massachusetts State Trooper, the defendant was unable to produce his license; exhibited slurred speech; and allegedly failed several Field Sobriety Tests.  A subsequent search of the defendant's car also yielded one empty bottle of Vodka under the driver's seat; and another half-empty bottle of Vodka near the driver's area.  He refuses to take the Breathalyzer Test and is arrested for Operating Under the Influence of Alcohol.

After trial, the Defendant is found NOT GUILTY.
