Embezzlement

The crime of Embezzlement is the unlawful conversion of the property of another with the intent to steal it.

Massachusetts General Laws Chapter 266, Section 30, punishes those convicted of the crime of Embezzlement with up to 2 years in the House of Corrections, or up to 5 years in state prison.

To prove the crime of Embezzlement, the prosecutor is required to prove, beyond a reasonable doubt:

1. That the defendant, while in a position of trust or confidence, was entrusted with possession of personal property belonging to another person;
2. That the defendant fraudulently took, hid or converted that property for his own use without the consent of the owner; and
3. That the defendant did so with the intent to deprive the owner of that property permanently.
